Do's and don't's of divorce

Divorce proceedings are never easy. Many people enter a divorce without much consideration as to the consequences. Rather than rush in we recommend that everyone should do some soul searching research. Read other peoples experiences and advice in order to take a balanced view on what your options are and perhaps regain some perspective on your particular situation.

 
 

 
 

Divorce or Separation?

Often a temporary separation in a marriage can be enough to give each partner time and space to think about the future and what they really want.

This is far better as a first step rather than engaging lawyers or solicitors straight away for the divorce proceedings.

 
 

 
 

Do Prenuptial Agreements Work?

The Jury is still out on this issue. Many courts do not recognise the legal aspect for which they were intended. Family law will always win over any pre-formed personal contracts between individuals prior to marriage.

However, were a divorcing couples affairs are uncomplicated Courts are taking into consideration 'aspects' of the prenuptial agreement that will help to resolve any disputes a lot sooner or add weight to a personal grievance.

We think that it won't be long before most prenuptial agreements will be treated as fully binding contracts provided they conform to contract law which is essentially based on fairness. Unfair or unreasonable prenuptial contracts will still be deemed unworkable.
